How a procedural term is counted
- A term starts on the next day after the event it runs from (CPC Art. 123(1), CCP Art. 116(1), CAP Art. 120(1)).
- A term in days ends on its last day. A term in months ends on the same date of the last month; if that month has no such date, on its last day. A term in years ends on the same month and date of the last year.
- A weekend or a public holiday. If a term ends on a weekend, a public holiday or another day off, the last day is the first working day after it (CPC Art. 124(3), CCP Art. 116(4), CAP Art. 120(6), CrPC Art. 115(7)).
- A missed term can be renewed by the court on an application if the reason is valid (CPC Art. 127, CCP Art. 119, CAP Art. 121, CrPC Art. 117). Martial law alone does not extend procedural terms.
The calculator does not apply special rules: terms in hours, terms of detention, days when a term is suspended, and terms set by the court. Check the term against the code in force.
