1. Оцінка предмета застави здійснюється у випадках, встановлених договором або законом.
2. Оцінка предмета застави здійснюється заставодавцем разом із заставодержателем відповідно до звичайних цін, що склалися на момент виникнення права застави, якщо інший порядок оцінки предмета застави не встановлений договором або законом.
