Arts. 182–184 of the Family Code · subsistence minimum for children
Child support calculator
Enter the dates of birth of the children and, if you know it, the income of the payer. The calculator shows the minimum child support, the share of income under a court order and the limits.
How the amount of child support is set
- The income of the payer is the sum left after taxes, levies and the single social security contribution are withheld. The share of the support is taken from it (Art. 70(1) of the Law on Enforcement Proceedings).
- The share of income is set by the court (Art. 183(1) of the Family Code). For two or more children the court sets one share, recovered until the eldest child comes of age (Art. 183(2)).
- The eldest child comes of age. If no parent goes to court about the support for the other children, the support is recovered less the equal part that fell on the child who came of age (Art. 183(3)).
- A court order. Without a claim one can recover a quarter of the income of the payer for one child, a third for two, and a half for three or more, but not more than ten subsistence minimums for each child (Art. 183(5)), or 50 % of the subsistence minimum as a fixed sum (Art. 184(3)).
- The minimum. Support for one child cannot be less than 50 % of the subsistence minimum for a child of that age. The recommended amount is the full subsistence minimum, if the income of the payer is enough (Art. 182(2)). For several children, the calculator splits the share into equal parts and compares the part of each child with the own minimum of that child. This is our reading of the law: we found no position of the Supreme Court on it.
- The age of a child counts from the birthday, on the date of the calculation. Until the day a child turns 6, the subsistence minimum for children under 6 applies; from that day, the one for children from 6 to 18. After the child comes of age, no support is recovered under Art. 180.
- What the court weighs: the health and the means of the child and of the payer, the other children and dependants of the payer, the property of the payer and spending above the income (Art. 182(1)).
- A fixed sum is indexed each year unless the parties agree otherwise (Art. 184(2)). Support is paid until the child comes of age (Art. 180).
The calculator shows the limits of the law, not a decision of a court: in a claim the court sets the amount from the facts of the case. The subsistence minimum is that of the State Budget Law of the year of the calculation.
