Невідповідним ступеню тяжкості кримінального правопорушення та особі обвинуваченого визнається таке покарання, яке хоч і не виходить за межі, встановлені відповідною статтею (частиною статті) закону України про кримінальну відповідальність, але за своїм видом чи розміром є явно несправедливим через м’якість або через суворість.
