Порядок користування жилою площею в гуртожитках визначається договором, що укладається перед вселенням на надану жилу площу в гуртожитку на підставі спеціального ордера відповідно до Примірного положення про користування жилою площею в гуртожитках, що затверджується Кабінетом Міністрів України.

Особливості користування жилою площею в гуртожитку, який підлягає передачі у власність територіальної громади, визначаються законом.
